Now, governments are catching up, and the rules of the game have changed.
AI regulation is no longer theoretical. The EU AI Act is in active enforcement: prohibited practices have been subject to penalties since February 2025, with full requirements for high-risk AI systems taking effect in August 2026 and fines reaching up to 7% of global annual revenue.
In the United States, a December 2025 executive order directed federal agencies to challenge state AI laws and push for a single national framework, reflecting a regulatory landscape still very much in flux.
The uncomfortable reality for most C-suites: their organizations are not ready. The gap between deploying AI and governing it has never been wider. Closing that gap, without killing innovation in the process, is a defining leadership challenge of 2026.
What makes this moment different from previous cycles of AI policy discussion is simple: the rules now have teeth.
The EU AI Act establishes the world’s first comprehensive legal framework for AI, applying graduated obligations based on risk. High-risk systems, including AI used in employment decisions, credit assessments and supply chain functions, face the most demanding requirements: risk management processes, technical documentation, human oversight and EU database registration.
The August 2026 deadline is not a soft target, and enforcement infrastructure across member states is already operational. The pressure extends beyond Europe: U.S. state-level statutes are multiplying, and ISO/IEC 42001, the first global standard for AI management systems, is becoming a baseline in enterprise procurement contracts worldwide.
Compliance with AI regulation requires knowing what AI you have, where it operates and what decisions it influences. For most enterprises, that baseline visibility simply does not exist.
According to research from Secure Privacy, 90% of enterprises now use AI in daily operations, yet only 18% have fully implemented governance frameworks. A Gartner survey of 360 organizations conducted in Q2 2025 found that organizations with AI governance platforms in place were 3.4 times more likely to achieve high governance effectiveness than those without. The gap between knowing you need governance and actually having it is enormous.

Shadow AI compounds the challenge. When AI is embedded in vendor updates or deployed by business units without oversight, the result is invisible risk. For procurement and supply chain teams, where agentic AI is increasingly selecting suppliers, flagging invoice exceptions and assessing contract risk, this is not a theoretical concern. Any AI that influences employment or commercial access may trigger regulatory requirements regardless of how it arrived.

The organizations making the most progress share a common trait: AI governance has executive ownership, cross-functional participation and a mandate that extends into vendor relationships.
In practical terms, this means a live inventory of every AI system in production, classified by risk and function; defined accountability for who owns AI outcomes and who can halt a deployment; human oversight proportional to risk; and documentation that travels with the system from design through monitoring.
Critically, governance must extend beyond internal systems. Your technology partners’ AI is your regulatory exposure. Contracts with AI-enabled software vendors should include provisions covering risk classification, documentation access, incident reporting obligations and the right to audit automated decision logic.

The instinct in many organizations is to treat regulation as a brake on AI progress. The evidence points in the opposite direction.
Organizations that invest in governance infrastructure early deploy AI faster over time. With established risk classification criteria and approval workflows, new use cases move through them quickly. Without that infrastructure, every new deployment triggers a scramble.
Enterprise buyers and partners are increasingly demanding evidence of AI governance maturity as a condition of doing business, and companies that can demonstrate clean audit trails and documented oversight protocols are the winners deals others are losing. The regulatory deadline is, in this sense, a forcing function to build something that creates durable advantage, not just legal protection.
The era of ungoverned AI deployment is over. It’s being replaced by a more disciplined approach, where competitive advantage flows to organizations that deploy AI with confidence, accountability and speed.
